The logical fix for this is to allow the nether to use the full 256 blocks of height for generation. This height increase has existed since mid 2012 and this is prime time for the nether to be expanding its domain and claiming this unused territory.
This is presumably because the new trees inherit from the mushroom and mushrooms would grow on the nether roof previously
Might be a feature (as small mushrooms can grow there anyway), but the real problem is that it allows mob's to spawn on them above the nether roof. Could add a check if a fungi could be placed before the tree is placed as neither of the new fungi can be placed on nether roof?
Can confirm for other random seeds.
