Server won't ban people who die in hardcore mode

Started a server, set hardcore mode to true in the server properties file. Friend died, but was able to respawn. This has happened multiple times across multiple servers I've made.

it is in 1.7.9, so it's banned-players.txt

Uhm, sorry, 1.7.9 already uses the new UUID scheme, it's in fact banned-player.json

my fould, I'm still used to my old memories of the pre-1.7 versions, 1.7.2 did still have txt

Is this still a concern in the current Minecraft version 14w31a / Launcher version 1.5.1 or later? If so, please update the affected versions in order to best aid Mojang ensuring bugs are still valid in the latest releases/pre-releases.

This is an issue still in 1.8

if you don't set hardcore mode to true before the world is generated then you will be able to re-spawn.

this not an issue with the client, but the server its self

Is this still an issue in the most recent versions (currently that is 1.10.2, or 16w42a) of Minecraft?
