The piston shown in the picture can extend when I power the lever, but it will not retract properly when I unpower the lever until it's updated. It seems to be very coordinate dependant with the piston glitching with the source of power at different distances from the piston. All you need to do to replicate it is to place a sideways facing piston and place blocks with redstone on top going out (away from the piston head) and up by one. You might need to go out more than one block depending on the coordinate for it to work but in the end, by unpowering any redstone connected to the redstone at the end, the piston will never retract.

This has two causes: Because of MC-108, both of the sections of redstone on your cyan blocks can power the piston. However, the order in which they're unpowered (which depends on location, as per MC-11193) will determine whether or not they're both unpowered before the piston receives its block update. If either one is still powered when it receives the block update, then it won't retract.
