Eating After Death

Please provide detailed steps to reproduce.

If I tp myself up 50 blocks (enough for me to die) and start eating a food item before I hit the ground and die before I finish eating I will continue to eat the food item, after death, before I respawn. I have tested this with many food items and potions and it worked for me in 16w07a and 16w07b.

This is a more clear explanation:
1) Tp yourself 50 blocks up (so that you will die when you hit the ground)
2) Start eating when you are about 10-20 blocks above the ground (so you will die before you finish eating)
3) Watch as you continue eating after you die.

You will still eat after you're dead, even if you are not pressing the "use item" key.

One reason this could be a problem is if you eat a golden apple and gain absorption hearts dead players may be detected by command blocks as having 4 hearts (half hearts) of health. (I have not tested this but it is a possibility)

Is this going to be fixed before 1.9?
