Sometimes the cape button disappears, It may be due to wifi or something but it disappeared for me 2 times today. One time earlier when my wifi seemed sucky and a second time today not long after I logged back into xbox live account, because I used a trick to fix an issue I had with the loading screen.
What seems to fix it is logging out of my xbox live account and logging back in.
