Observers give off a one tick pulse right? Well when the face of an observer is facing up and it detects an update, it gives a constant output.

The observer is not providing constant power. The piston is powered by the redstone wire on top of the observer due to MC-108.

Ingame workaround: User a power/activator rail instead of Redstone dust.
