If something is done that causes particles to fall or break off (Eating, Breaking blocks, breaking tools) while water is visible, the particles will appear to be behind the water.
This happens on all game modes
This happens when resource packs are on and off
This happens with default video options (I believe it still happens with customized options as well)
This happens on vanilla and modded minecraft.
