as already described: the issue disappeared with either updating to 1.7.1 or changing from openjdk to oracle's java (did both at the same time)
i haven't run tests with 1.7.1 (or older) with openjdk together but as things are now it is working (if could run some tests if it helps)

ok did two changes,
1st changed from openjdk to oracle jdk,
2nd tried out 1.7.1,

one of those two seams to have fixed the issues (not everyone who had this problem was on the server yet, but all who helped testing had no issues anymore).

no! i probably formulate that a bit fishy, i just didn't know how to formulate it other way. a 'laggy person' in my description is not a person with a high ping (the same persons have no problem when the server is running on 39b) they are ppl who generate (w41+) a huge amount of SERVERSIDE lag on joining (again, on snapshot 41+ including the pre-reslease).
