While playing the background music still triggers despite the "Music: OFF" setting in the options.
Turning the music volume up then back down to "off" fixes the issue.
The music does not appear to play for the rest of the session if the above "fix" is applied. But when the game starts with the "music off" setting, the music can play.
(And yes I did search, nothing found)

That's not what the ticket says...
If the game STARTS with the "Music: OFF" setting, then the background music still plays (this could be half an hour later).
