Just to update: checked after work yesterday and the update was finally available. From what I could find online while I was waiting they have been rolling out the update over the past week, which is why people got it at different times. 

Ive been told by a fellow switch user that they got an update yesterday 1.16.40. Its been 24hrs and I haven't got the update. I'm in Australia they are in America. Any else have it?

Also having this issue. But it also happens randomly in game like when I'm just running around. 

Also having this issue. Many when trying to use chat in game. But it also randomly freezes for about 30 seconds at any point in the game.
