The warden can spawn on blocks that it won't be able to stand on, therefore, immediately falling though.
How to reproduce:
Create a space devoid of nearby blocks.
/fill an area with any blocks that don't have collision (i.e. sculk veins).
Use a shrieker with can_summon set to true to summon the warden naturally.
The warden successfully spawns in the area.

Actually I noticed that Warden has gravity while appearing, by observing its hitbox. For example if it appears on Sculk Vein which has a solid block below, the hitbox shows above the Vein first and then drop on the solid block.
Also please make it so wardens only spawn if the ground is at least two blocks thick, and also only in non transparent blocks.
I can confirm this behavior.
