Some fossils are completely underground as well when you go into spectator mode. This is likely from the same code as floating fossils.
But that's a related bug.

Fossils can still generate in the air, but only if a cave/ravine removes the ground below it.

Can confirm in 20w51a although, the provided coordinates no longer work. I did manage to find a floating fossil on the same seed, however. Here are the new coordinates:
